Abstract:
This dissertation investigates the factors contributing to delays in crime
investigations by the Tanzania Police, with a focus on the Mara Region. Delays in
these investigations pose significant challenges to law enforcement and the criminal
justice system, raising concerns about their effectiveness amid rising crime rates and
unresolved cases. Timely investigations are essential for upholding justice and
protecting individuals' rights. However, challenges persist, particularly with Section
225(6) of the Criminal Procedure Act CAP 20 R.E 2022, which allows certain
offenses to bypass the sixty-day investigation requirement. This provision, while
acknowledging case complexities, lead to prolonged investigations that violate the
right to timely justice. Using a qualitative approach, this study provides a
comprehensive understanding of the challenges faced by police personnel in
conducting timely investigations. Data were gathered through in-depth interviews
with police investigators and other stakeholders, yielding nuanced insights into the
systemic issues affecting investigation timelines. Key factors identified include
inadequate resources, staffing shortages, lack of specialized training, and procedural
inefficiencies. Participants highlighted that insufficient funding and outdated
technology hinder their capacity to conduct thorough investigations, while poor
coordination and communication among police departments and community
stakeholders exacerbate delays. The study explores the profound consequences of
these delays, noting that victims often express frustration and disillusionment, which
affects their willingness to report crimes and diminishes overall community safety.
The research underscores the urgent need for reforms within the Tanzania Police
system to address these systemic barriers. To mitigate delays, the study proposes
several actionable strategies, including enhancing training programs focused on
investigative skills, improving resource allocation, and fostering stronger
collaboration with community members. By implementing these strategies, the
Tanzania Police can enhance their efficiency and effectiveness in crime
investigations, ultimately restoring public confidence in law enforcement. This
qualitative exploration contributes valuable insights into the complexities of policing
in Tanzania and highlights the necessity for comprehensive reforms.
